WASHINGTON – Today, U.S. Senator John Hickenlooper and 13 Senate Democrats introduced a resolution to affirm that the Constitution vests the judicial power in the federal courts and that the executive branch must comply with all federal court rulings.
“In our democracy, no one is above the law – not even a president. Failure to respect the rule of law threatens the foundations of our system of checks and balances,” said Hickenlooper.
In recent weeks, several federal judges have issued decisions and orders limiting actions taken by the Trump Administration. In response to these judicial decisions, several Trump Administration officials and allies have made troubling statements criticizing federal judges and judicial review.
In response, Supreme Court Chief Justice John Roberts said, “For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision. The normal appellate review process exists for that purpose.”
This resolution acknowledges the principle of judicial review and the serious threat that disregarding a federal court’s decision poses to our constitutional order and the separation of powers that underpins it.
